Data privacy statement for applicants

Data protection is a major concern at KNDS Deutschland GmbH & Co. KG, based in 80997 Munich, Krauss-Maffei-Straße 11. For that reason, your data are processed exclusively in compliance with the statutory data protection regulations.

We collect and process your personal data so that we can perform the selection procedure for the advertised position. The data you provide will be processed for the purpose of processing your application and, in the event that an employment relationship is established, also for carrying out the employment relationship. No processing is conducted for other purposes.

Personal data mean all data and information about yourself which you have provided us with and which are related to you or which can be used to establish a connection to you. We collect and process the following personal data from you:

surname, first name, date of birth, place and country of birth, residential addresses, citizenships, green card holdings, telephone numbers, E-mail address, curriculum vitae (including details of previous employers, school and vocational training, studies, further education and training), qualifications, references, if applicable, data of spouses/registered partners if necessary in the scope of the Security Screening Act (Sicherheitsüberprüfungsgesetz, SÜG), only in the case of penalties which are subject to the unrestricted obligation to provide information: whether previous convictions exist to that effect or proceedings are in progress. The above-mentioned personal data are processed for the following purposes:

  • Preparation of contracts including identification and communication with you e.g. to process your requests; invitation to interview, or issue a rejection
  • Settlement of legal disputes and to assert, exercise and defend legal claims.

The processing of the personal data is necessary to achieve the above-mentioned purposes. Legal basis for the data processing is Article 6 (1) (b) and (f) of the General Data Protection Regulation.

The data you transfer to us will be kept confidential. Application documents are only made available to the persons at our company who are directly involved in filling the vacancy. Your documents will be submitted to the works council and, if applicable, to the representative council of employees with disabilities, if an employment relationship is established as well as to safeguard their rights during the application procedure. Applications which are also to be used for other positions are also forwarded within the company to the positions for which the applications are also intended. You may withdraw your consent to the transfer and further processing of your documents at any time. In case of withdrawal, your documents and personal data can no longer be considered for the ongoing application procedure.

If legally permissible and necessary to comply with applicable law or assert, exercise or defend legal claims, we will transfer your personal data to courts, tax authorities and supervisory authorities. However, we take all measures to ensure the suitable and appropriate guarantees to protect your personal data.

No personal data will be transferred to third parties as long as no legal regulations require doing so or doing so is not necessary for contractual reasons (e.g. for travel bookings) or in your interest. Third parties are persons or bodies outside our company who do not process personal data at our instruction.

In case of transfer to recipients in non-member states (outside the EU/EEA), the transfer will only take place if the EU Commission has determined an adequate level of data protection for this non-member state or if we have agreed upon suitable contractual guarantees with the recipient to ensure an adequate level of data protection.

If an employment contract is established between yourself and us, the data transferred will be saved for the purposes of processing the employment relationship in observation of the statutory regulations. If an employment contract is not concluded with you, your application documents will be deleted six months after the rejection decision has been announced at the latest, provided that our company has no other legitimate interests that would oppose deletion. Another legitimate interest in this sense is the obligation to provide evidence in proceedings under the General Equal Treatment Act (AGG), to name one example.

Rights of data subjects: Right to information, correction, deletion and restriction of your personal data, right to objection and right to data portability

Upon request, we will inform you whether and what personal data we save at our company in writing as per applicable law.

You also have the right to demand the processing of personal data by us to be restricted. You may furthermore request to obtain the data you have provided us with in a structured, conventional and machine-readable format. You may also object to the processing of personal data by us.

You have the right to demand the deletion of your personal data, unless statutory retention periods oppose doing so.

If you have consented to the processing of your personal data, you have the right to withdraw your consent at any time with future effect. Withdrawal of consent does not make data processing unlawful for the past.
